Noosa & Hinterland Family Lawyers
Noosa & Hinterland Family Lawyers was formed in 2023, with the merger of local practices, Cooroy Legal Centre and Noosa’s McCarthy Family Law.
Our new name was chosen to celebrate the firm’s wide experience in all types of family law matters: divorce, parenting, property settlements, domestic violence and child protection issues.
Together, our lawyers have more than 70 years’ experience between them in helping families to negotiate new arrangements after separation.

Divorce & Separation Law

Family Mediation
As per current regulations, separated couples disputing matters related to property division or childcare are obligated to first attempt non-adversarial dispute mediation.
This Family Dispute Resolution process mandates that both parties make a sincere effort to reach an agreement before proceeding to litigation.
The aim is for couples to openly communicate, better understand each other’s perspective and find middle ground with an unbiased mediator facilitating the dialogue.
Embracing this compulsory step demonstrates a commitment not only towards a fair settlement but also to reducing conflict during an already challenging transition.
Family Dispute Resolution
During the turmoil of family breakdown couples may experience difficulty identifying, discussing and agreeing on matters that will significantly change the lives of their children.
It is now mandatory that the parties participate in a Family Dispute Resolution conference facilitated by a qualified and accredited Family Dispute Resolution Practitioner who acts impartially and independently. A Family Dispute Resolution conference is an alternative solution to Court proceedings.
As both Family Lawyers and accredited Family Dispute Resolution Practitioners we will help you to recognise and confirm disputed issues in a timely manner and guide you through the mediation process. Our goals are to reduce the intensity and duration of disputes, and to arrive at mutually agreed solutions pursuant to the Family Law Act. These solutions will then be drafted into enforceable Orders by Consent.

Orders by Consent
Noosa & Hinterland Family Lawyers appreciate the difficulties and the legal costs associated with resolving Family Law Matters.
If you and your partner are prepared to negotiate amicable solutions in your family law matter, we will provide you with our qualified advice and expertise, enabling you to apply to the Court for Parenting Orders and Property Orders by Consent.
This process enables parties to reach agreement without the need for costly and potentially lengthy Court proceedings.
Orders by Consent formalise the agreement between parties and are legally binding once ordered by the Court.

Recovery Orders
Parenting arrangements do not always proceed smoothly or as planned. Your child may not be returned to you at the agreed time or you may have concerns for the welfare of your child while in the care of the other parent.
In these situations, it may be appropriate for you to apply to the Court for a Recovery Order for the safe return of your child.
Noosa & Hinterland Family Lawyers understand the seriousness of Recovery Order matters. We place high priority on drafting and filing the documents necessary to apply to the Court for a Recovery Order or, if applicable, an Urgent Recovery Order.

When Court Becomes Necessary
Many matters are resolved via the Family Dispute Resolution process without the need for costly and lengthy Court proceedings. However, some matters are extremely complex, and despite all your efforts, will end up before the Court.
The lawyers at Noosa & Hinterland Family Law have extensive Court experience in both Property Settlement and Parenting Matters. We will advise, guide and keep you informed from the start to the completion of your Property Settlement and/or Parenting matter.
In Property Settlement matters your lawyer will direct you to gather the financial information required by the Court and then prepare the documents necessary for your application or response.
In Parenting matters your lawyer will advise and assist you with your application and communicate with the lawyer for the other party as required, always with the view to achieve and an outcome that is in the best interests of your children.
Before any Property Settlement or Parenting matter commences clients are informed about the potential costs involved. A written Costs Agreement outlining the costs you can expect along the way will be provided. We will always keep you informed.
